PeakTime Perks: EV Program Terms and Conditions

(Effective August 31, 2026)

Thank you for your interest in the EVX ChargeSmart Program (the "EVX Program") offered by Denton County Electric Cooperative, Inc., d/b/a CoServ Electric ("CoServ Electric") in cooperation with its services provider, FlexEnergi, LLC ("FlexEnergi").

THE EVX PROGRAM IS OFFERED UNDER THE TERMS AND CONDITIONS SET FORTH IN THIS ELECTRIC VEHICLE PROGRAM AGREEMENT ("AGREEMENT") AND ON THE CONDITION THAT YOU ACCEPT AND COMPLY WITH SUCH TERMS AND CONDITIONS. THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT AMEND AND REPLACE ANY PREVIOUS TERMS AND CONDITIONS FOR THE EV BETA PROGRAM AND SURVIVE THE PARTICIPATION PERIOD AND ANY TERMINATION OF YOUR PARTICIPATION IN THE EV BETA PROGRAM.

BY ENROLLING IN OR CONTINUING PARTICIPATION IN THE EVX PROGRAM, YOU (A) ACCEPT AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT, AND (B) REPRESENT THAT YOU ARE OF LEGAL AGE TO ENTER INTO A BINDING AGREEMENT. IF YOU DO NOT AGREE TO SUCH TERMS AND CONDITIONS, DO NOT ENROLL IN THE EVX PROGRAM.

The EVX Program is available only to CoServ Electric's residential electric customers who meet the following eligibility requirements ("Minimum Eligibility Requirements"): (1) you are a CoServ Electric member with a residential electric service account; (2) you charge an electric vehicle at the service location for such residential electric service account, (3) such electric vehicle allows telematics control via FlexEnergi’s software application (or a similar application selected by CoServ Electric) or have an EV charger that allows control via FlexEnergi’s software application and (4) you agree to all of the terms and conditions of this Agreement. CoServ Electric will verify your eligibility prior to your participation in the EVX Program and can deny or terminate your participation in such program at any time and for any reason whatsoever.

By enrolling in or continuing participation in the EVX Program, you are authorizing CoServ Electric and FlexEnergi (or any future services provider working with CoServ Electric on the EVX Program) to share between them information about you as described below, and you are authorizing CoServ Electric and FlexEnergi (or any future services provider working with CoServ Electric on the EVX Program) to verify that you are eligible to participate in the EVX Program and to evaluate the comprehensive energy impact of electric vehicle charging by you and other program participants. The information to be shared by CoServ Electric is your customer information concerning your residential electric service account, including, but not limited to, your name, contact information, account number, and service location address. The information to be shared by FlexEnergi (or any future services provider working with CoServ Electric on the EVX Program) is the information FlexEnergi obtains directly from you, or that is gathered or maintained through your use of its application (or a similar application selected by CoServ Electric), including, but not limited to, vehicle charging times, status of your vehicle, and vehicle location.

By enrolling in or continuing participation in the EVX Program, you represent and warrant that the information you have provided to CoServ Electric for your residential electric service account and as part of this Agreement is accurate and truthful and that you meet the Minimum Eligibility Requirements. You agree that CoServ Electric may terminate this Agreement, refuse to enroll you in the EVX Program, or terminate your participation in the Program if you are untruthful in the information you submitted, if you do not satisfy the Minimum Eligibility Requirements, or for any other reason whatsoever in CoServ Electric's sole discretion. You agree that you are participating in the EVX Program on a voluntary basis, and you may terminate your participation in the EVX Program and this Agreement upon providing CoServ Electric not less than ten (10) days’ advance notice of your desire to terminate your participation in the Program by emailing such notice to ev@coserv.com.

You release and hold harmless CoServ Electric and FlexEnergi (and any future services provider working with CoServ Electric on the EVX Program) from any injury, loss, cost, liability, claim, demand, cause of action, damage, or expense of any kind resulting from your participation in the EVX Program or under this Agreement.

This Agreement is effective upon your enrollment and will remain in effect until CoServ Electric terminates your participation in the EVX Program or cancels the EVX Program, or until you provide written notice of termination of your participation in the EVX Program pursuant to the terms above.

CoServ Electric reserves the right to make changes to the terms and conditions of this Agreement. CoServ Electric will post any such changes to the website currently located at https://staging649.coserv.com/evx-charge-smart, and the posting of such changes shall constitute notice to you of such changes.
